Terms & Conditions of Sale

These Terms and Conditions of Sale ("Terms") apply to every quote, order, sale and delivery of products by T&M Supplies Inc ("T&M," "we," "us"), 3191 SW 14th Place, Bay 6, Boynton Beach, Florida 33426, to the customer ("Buyer," "you"), whether the order is placed at our counter, by phone, by email or on our website. By placing an order or accepting delivery, you agree to these Terms. Any different or additional terms in your purchase order or other documents are rejected unless an officer of T&M agrees to them in writing.

1. Who we sell to

T&M is a wholesale distributor. We sell primarily to HVAC/R contractors, service companies, facilities and maintenance departments, and other businesses. Trade pricing is available to approved account holders. Some products, including refrigerants, may only be sold to properly certified buyers (see our Refrigerant Sales Policy). We may require proof of a valid contractor license, business registration or certification before completing a sale.

2. Quotes and pricing

• Written quotes are valid for 30 days unless the quote states otherwise, and are subject to product availability.
• Prices are in U.S. dollars and do not include sales tax, delivery, freight or special handling charges unless stated.
• Prices may change without notice because of manufacturer price increases, surcharges, tariffs or market conditions. The price that applies is the price in effect on the day the order is invoiced, unless a written quote covers the order.
• We will correct pricing, typographical and description errors on our website, quotes and invoices, even after an order has been placed. If a correction changes your price, we will contact you before shipping and you may cancel the order.

3. Orders and acceptance

An order is accepted only when we confirm it, ship it or release it at the counter. We may refuse or cancel any order, including orders that appear fraudulent, orders from accounts past due, or orders for restricted products where the buyer cannot show the required certification. Stock shown on the website is not a guarantee of availability.

4. Special orders and cancellations

Special-order, non-stock, custom-built and drop-shipped items may require a deposit and cannot be cancelled or returned once ordered from the manufacturer, unless the manufacturer accepts the cancellation. Any manufacturer cancellation or restocking charges will be passed through to you.

5. Payment

Payment is due at the time of purchase unless you have an approved credit account. We accept cash, major credit and debit cards, company checks from approved accounts, and ACH. Account terms are described in our Credit & Net Terms Policy.

6. Taxes

Florida sales tax and any applicable county surtax will be added to taxable sales unless a valid resale or exemption certificate is on file before the sale. See our Sales Tax & Resale Certificates policy.

7. Delivery, title and risk of loss

Title and risk of loss pass to you when products are picked up at our counter, delivered to your job site or delivered to a carrier for shipment, whichever happens first. See our Shipping, Delivery & Pickup policy for inspection and damage-claim requirements.

8. Returns

Returns are handled under our Return & Refund Policy.

9. Warranty and disclaimer

Products are covered only by the manufacturer's warranty, as described in our Warranty Policy. EXCEPT FOR THOSE MANUFACTURER WARRANTIES, T&M SELLS ALL PRODUCTS "AS IS" AND DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE EXTENT PERMITTED BY LAW.

10. Product selection, installation and codes

You are responsible for selecting the right product for your application and for installing it according to the manufacturer's instructions, applicable building, mechanical, electrical and energy codes, and EPA regulations. Technical help from our counter staff is a courtesy and does not replace the manufacturer's specifications or the judgment of a licensed professional. HVAC/R equipment should be installed by a licensed contractor; improper installation can void the manufacturer's warranty.

11. Limitation of liability

TO THE EXTENT PERMITTED BY LAW, T&M'S TOTAL LIABILITY FOR ANY CLAIM RELATED TO A PRODUCT OR ORDER WILL NOT EXCEED THE PRICE YOU PAID FOR THAT PRODUCT. T&M IS NOT LIABLE FOR LABOR, TRAVEL, REFRIGERANT, LOST PROFITS, DELAY, LOSS OF USE, PROPERTY DAMAGE CAUSED BY INSTALLATION, OR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES.

12. Delays

We are not responsible for delays or failure to deliver caused by manufacturer shortages, carrier delays, weather, hurricanes, natural disasters, labor disputes, government action or other events outside our reasonable control.

13. Collections

If we must take action to collect amounts you owe, you agree to pay our reasonable costs of collection, including attorney's fees and court costs, to the extent permitted by law.

14. Governing law and venue

These Terms are governed by the laws of the State of Florida, including the Uniform Commercial Code as adopted in Florida. Any lawsuit related to a sale will be brought in the state or federal courts serving Palm Beach County, Florida.

15. Changes

We may update these Terms at any time. The version posted on our website on the date of your order applies to that order.

Return & Refund Policy

Effective November 6, 2026

We want you to get the right part the first time. If you need to return something, these are the rules. Bring your invoice or order number; returns without proof of purchase from T&M cannot be accepted.

Standard returns

• 30-day window. Stocked items may be returned within 30 days of the invoice date.
• New and unused. Items must be new, uninstalled, unused, undamaged and in the original, unopened or resealable manufacturer packaging, with all parts, manuals and accessories.
• Restocking fee. Returns that are not our error may be charged a 15% restocking fee. There is no restocking fee when we picked, shipped or quoted the wrong item.
• After 30 days. Returns between 31 and 60 days are at our discretion and may carry a higher restocking fee. We do not accept returns after 60 days.

Items that cannot be returned

• Special-order, non-stock, custom-built or drop-shipped items (unless the manufacturer accepts the return; any manufacturer charges are passed through).
• Electrical and electronic components that have been installed, wired, tested or removed from sealed packaging, including control boards, thermostats, relays, sensors, contactors and capacitors.
• Refrigerant cylinders, and opened or used chemicals, oils, cleaners, sealants, leak stop and dyes.
• Copper tube, line sets, insulation, duct, wire and other products cut to length.
• UV-C lamps and other items with broken seals for health, safety or hazardous-material reasons.
• Equipment (condensing units, air handlers, mini-splits and similar) that has been installed, charged, started up, or delivered with a signed clean delivery receipt and then damaged.
• Clearance and "final sale" items.

Wrong item or shipping damage

If we sent the wrong item or it arrived damaged, tell us within 2 business days of receipt. For freight shipments, damage must also be noted on the carrier's delivery receipt (see our Shipping policy). We will replace the item or issue full credit with no restocking fee.

Defective products

A product that fails is a warranty matter, not a return. Defective items are handled under the manufacturer's warranty through our Warranty Policy.

How refunds are issued

• Account customers receive a credit to their account.
• Card purchases are refunded to the original card, usually within 5 to 10 business days after we receive and inspect the return.
• Cash and check purchases are refunded by store credit or company check. Refunds on check purchases may be held until the check has cleared.
• Original delivery or freight charges are not refundable unless the return is due to our error.

How to return

Bring the item and your invoice to the counter at 3191 SW 14th Place, Bay 6, Boynton Beach, or call 855-999-3828 to arrange a pickup or a return authorization for shipped orders. Items shipped back to us without a return authorization may be refused.

Shipping, Delivery & Pickup Policy

Effective November 6, 2026

Counter pickup (will call)

Orders placed by phone, email or online can be picked up at our counter at 3191 SW 14th Place, Bay 6, Boynton Beach, FL 33426 during business hours. We will let you know when your order is ready. Please bring your order number. Orders not picked up within 7 days may be returned to stock.

Local delivery

We offer job-site and shop delivery within Palm Beach County. Delivery days, cut-off times and charges depend on location and order size; ask the counter for details. Someone must be available to receive and sign for the delivery. If no one is available, the driver may leave the order at the address at the customer's risk or return it to the branch, and a redelivery charge may apply.

Shipping by carrier

• Parts and small items ship by parcel carrier. Equipment and large orders ship by LTL freight.
• Shipping charges, freight, liftgate, residential-delivery and other accessorial charges are added to your invoice unless otherwise quoted.
• In-stock orders placed before our daily cut-off normally ship the same or next business day. Delivery times are estimates and are not guaranteed.
• We ship within the continental United States. Ask us about other destinations.

Hazardous materials

Refrigerants, aerosols, flammable chemicals and some batteries are regulated as hazardous materials. They ship by ground only, may carry hazmat fees and cannot ship to some addresses. Refrigerant purchases also require certification (see our Refrigerant Sales Policy).

Inspect your delivery

Inspect every shipment before signing. Count the pieces and check for damage, especially on equipment. If anything is damaged or missing:

• Write "DAMAGED" or "SHORT" and a short description on the carrier's delivery receipt before signing. Take photos.
• Call us at 855-999-3828 within 2 business days.
• Keep the product and all packaging until the claim is settled.

If the delivery receipt is signed without noting damage, the carrier may deny the claim and we cannot accept a return of the damaged item. Concealed damage must be reported within 2 business days of delivery.

Title and risk of loss

Title and risk of loss pass to you when the order is picked up, delivered by our truck, or handed to the carrier. We will help you file freight claims for shipments we arranged.

Warranty Policy

Effective November 6, 2026

T&M Supplies is a distributor. Products we sell are covered by the warranty of the company that makes them, not by a separate T&M warranty. We help our customers process warranty claims with the manufacturer.

What is covered

Coverage, length and terms are set by each manufacturer and vary by product and brand. Warranty terms are included with the product or available from the manufacturer, and we can provide a copy on request. Examples: many equipment warranties require online product registration within a set time after installation, and GreenUV air purification products carry a lifetime warranty that excludes lamps.

What is usually not covered

• Labor, travel, diagnostic time, refrigerant, or other materials used during replacement.
• Damage from improper installation, wiring, sizing or application, or installation not in line with the manufacturer's instructions and local codes.
• Damage from power surges, lightning, flooding, hurricanes, corrosion, abuse, neglect or lack of maintenance.
• Consumable items such as filters, belts, fuses, UV lamps and chemicals.
• Equipment installed by someone other than a licensed contractor when the manufacturer requires licensed installation.

How to file a claim

1. Call the counter at 855-999-3828 or use the warranty claim form on our website.
2. Provide your T&M invoice number, the product model and serial number, the installation date, the job address and a description of the failure.
3. Return the failed part, tagged with your name and claim details, when we or the manufacturer ask for it. Do not discard failed parts until the claim is closed.

For approved claims, we issue a replacement part or credit according to the manufacturer's decision. If you need a replacement before the manufacturer decides, we may require you to buy the replacement; we will credit you if the claim is approved. Dead-on-arrival parts reported within 30 days of purchase are usually exchanged at the counter, subject to the manufacturer's approval.

Credit & Net Terms Policy

Effective November 6, 2026

Qualified businesses can apply for an open account with net terms. Accounts are approved at T&M's sole discretion.

Applying

• Complete our credit application with your business information, trade references and bank reference.
• Provide your contractor license (if applicable), business registration and, for tax-exempt purchases, a Florida Annual Resale Certificate.
• We may check business and personal credit. A personal guarantee from an owner or officer may be required.
• Approval usually takes 2 to 5 business days. Until then, purchases are paid at the time of sale.

Terms

• Net 30. Unless your approval letter says otherwise, invoices are due in full 30 days from the invoice date.
• Credit limit. Each account has a credit limit. Orders over the limit may require payment or approval before release.
• Statements. We send monthly statements. Please report billing questions within 30 days of the invoice date; undisputed amounts must still be paid on time.
• Authorized buyers. You are responsible for all purchases made by your employees and anyone you allow to use your account. Tell us in writing to add or remove authorized buyers or to require purchase order numbers.

Late payments

• Past-due balances are charged a late fee of 1.5% per month (18% per year) or the highest rate allowed by law, whichever is lower.
• Accounts more than 30 days past due may be placed on credit hold, and new orders may require payment at the time of sale.
• Returned checks and rejected ACH payments are charged the service charge permitted under Florida law, and the account may be changed to cash or card only.
• You agree to pay reasonable collection costs, including attorney's fees and court costs.

Changes and lien rights

We may change your credit limit or terms, or close the account, at any time. Nothing in this policy waives T&M's rights as a supplier under Florida's Construction Lien Law, including the right to serve a Notice to Owner on projects we supply.

Refrigerant Sales Policy

Effective November 6, 2026

Federal law restricts who may buy refrigerant. Under the U.S. EPA's refrigerant sales restriction (40 CFR Part 82, Subpart F, issued under Section 608 of the Clean Air Act), ozone-depleting refrigerants such as R-22 and non-exempt substitutes such as HFC refrigerants (for example R-410A, R-134a and R-404A) may only be sold to qualified buyers. T&M follows these rules on every refrigerant sale.

Who can buy refrigerant from T&M

• Technicians certified under EPA Section 608 (Type I, II, III or Universal, matching the equipment covered by the certification).
• Technicians certified under EPA Section 609 for motor vehicle air conditioning, for refrigerants used in that work.
• Businesses that employ at least one properly certified technician, when the business has given us written evidence of that employment. An authorized representative, such as an office manager, may then buy refrigerant on the company's account for its technicians.
• Refrigerant wholesalers and EPA-certified reclaimers buying for resale or reclamation.

What we need from you

• A copy of a valid Section 608 or 609 certification card, kept on file with your account, or shown at the time of purchase.
• For company accounts, written proof that the company employs at least one certified technician.

We will not sell refrigerant without this documentation, and we keep sales records as required by EPA. Refrigerant listed on our website can only be purchased by certified buyers. This restriction does not apply to equipment that comes factory-charged with refrigerant.

Handling and venting

Knowingly venting refrigerant during service, maintenance, repair or disposal is prohibited by federal law. Refrigerant must be recovered using certified recovery equipment. Ask our counter about cylinder returns and refrigerant recovery options.

Returns

Refrigerant cannot be returned once it leaves our counter or warehouse.

Sales Tax & Resale Certificates

Effective November 6, 2026

As a Florida seller, T&M must collect Florida sales tax, plus any applicable county discretionary sales surtax, on taxable sales unless we have a valid exemption document on file before the sale.

Buying for resale

If you are buying products to resell, give us a copy of your current Florida Annual Resale Certificate for Sales Tax. We may verify it with the Florida Department of Revenue. Certificates expire each year; please send us the new one when it is issued.

Contractors

Under Florida law, contractors who install materials into real property (for example, under a lump-sum or time-and-materials contract) are generally treated as the final consumer of those materials and pay sales tax when they buy them, even if the job is for a tax-exempt customer. A resale certificate may not be used for materials you will install. Talk to your tax advisor about your situation.

Tax-exempt organizations

Organizations with a Florida Consumer's Certificate of Exemption must provide a copy, and purchases must be paid directly by the exempt organization.

Refunds of tax

Tax charged on a sale is refunded only when a valid certificate that was in effect on the date of sale is provided within 30 days of the invoice.

Privacy Policy

This Privacy Policy explains how T&M Supplies Inc collects, uses and protects personal information when you visit our website, open an account, or buy from us online, by phone or at our counter.

Information we collect

• Contact and account information: name, company name, job title, address, phone number, email address, contractor license number and EPA certification details.
• Order information: products purchased, quotes, job addresses, delivery details and order history.
• Credit application information: business and bank references, tax ID, resale certificates and, if you provide a personal guarantee, information needed to review personal credit.
• Payment information: card payments are processed by our payment processor. We do not store full card numbers on our systems.
• Website information: IP address, browser and device type, pages viewed and similar data collected through cookies and analytics tools.
• Communications: messages, calls, warranty claims and other information you send us.

How we use it

• To process orders, deliveries, returns and warranty claims.
• To open and manage accounts, review credit applications and collect payment.

How we share it

We do not sell your personal information. We share it only as needed with:

• Service providers that help us run the business, such as payment processors, carriers, delivery partners, accounting, email and website hosting providers.
• Manufacturers, to process warranty claims and product registrations.
• Credit reporting agencies and references, when you apply for credit.
• Government agencies, courts or others when required by law, or to protect our rights and collect amounts owed.
• A buyer or successor if our business is sold or reorganized.

Cookies

Our website uses cookies and similar technologies to keep the site working (for example, your cart), remember your preferences and understand how the site is used. You can block or delete cookies in your browser settings, but some features may not work.

Text messages

If you sign up for text messages, we use your number only to send the messages you asked for, such as order-ready alerts. Message and data rates may apply. Reply STOP to opt out at any time. We do not share mobile numbers or text opt-in consent with third parties for their marketing.

Security and retention

We use reasonable administrative, technical and physical safeguards to protect personal information. No system is completely secure. We keep information as long as needed for the purposes above and as required by law, including tax, accounting and EPA recordkeeping rules.

Your choices

You may ask to see, correct or update the personal information in your account, or ask us to delete information we are not required to keep. Contact us using the details below.

Children

Our website and services are for businesses and adults. We do not knowingly collect personal information from children under 13.

Our website links to manufacturer and other websites. We are not responsible for their privacy practices.
